7.1 The Qkr!™ mobile software application is made available to you by MasterCard Incorporated ("MasterCard") and the MasterPass™ mobile software application is made available to you by Capitec Bank Limited ("Capitec""we""us""our"), having been authorised to do so by MasterCard. The Qkr!™ mobile software application and the MasterPass™ mobile software application shall collectively be referred to as the "Apps" and the Apps are available for download on Apple's App/iTunes Store or Google's Play Store.

7.2 We take your privacy seriously and we will comply with all applicable laws imposing obligations on us to safeguard your personal information. We ask that you read this privacy notice ("Privacy Notice") carefully as it contains important information about how we will use your personal information should we be exposed to it or have to process your personal information in the context of your use of the Apps.

7.3 For the purposes of the Protection of Personal Information Act, 4 of 2013, we are the ‘responsible party’ in respect of personal information you submit to us (i.e. the company who is responsible for, and controls the processing of, the personal information you submit to us).

7.4 We may obtain personal information about you (such as your name, email address, phone number, payment and transaction details) whenever you complete forms on any of the Apps or when you use any of the Apps.

7.5 We will also obtain personal information you provide when you download or register to use the Apps, send us feedback, post material, contact us for any reason and by any medium, sign up to a service, make purchases using the Apps, complete a survey, report a problem with any of the Apps. We may further retain a record of any contact you make with us.

7.6 We may monitor your use of the Apps through the use of cookies and similar usage tracking devices. For example, we may monitor how many times you use the Apps, which pages you go to, traffic data and transaction types. This information helps us to build a profile of our users. Some of this information will be aggregated or will be statistical in nature, which means that we will not be able to identify you individually.

7.7 We may also collect information about your device each time you use the Apps. For example, we may collect information on the type of mobile device that you are using and its unique device identifier (for example, the IMEI number, the device’s mobile phone number, or the MAC address of the device’s wireless network interface), the type of mobile browser that you are using, the mobile operating system that you are using and mobile network information.

7.8 We may use your personal information for the following purposes:

 a. to help us identify you and any accounts you hold with us;

We do not accept any responsibility or liability for their respective privacy policies/terms of use or the collection and use of any personal information collected through these websites, apps or services.  a. other companies within our group;

 b. our agents and service providers; and

7.14 We may need to transfer your personal information to the Republic of Ireland or the United States of America as this is where MasterCard will provide its services from and you consent to such transfers.

Capitec runs digital campaigns across social, various websites and Google from time to time where consumers can submit their information and request to be contacted by Capitec or to receive product information, in the manner as indicated within the campaign advertisement.

8.1 You understand that the personal information that you submit will be collected by Capitec and processed for the purpose of contacting you about the product or service that you enquired about.

8.2 Should you proceed to apply for a product or service and/or enter into a contract with Capitec, your personal information will then be processed for the purpose of entering into and performing in terms of such contract.

8.3 Capitec will retain your personal information for so long as it is required by law or for a longer period that is reasonably required to give effect to the legitimate interest of you and/or Capitec.

9.1 We may amend these conditions from time to time. By accessing this site you are bound to the version of the conditions published here at the time of any visit to this site. You agree to view the current version each time you access the site.

9.2 A certificate signed by the administrator responsible for maintaining this site will be prima facie proof of the date of publication and content of the current version and all previous versions of the conditions.

9.3 Nothing on this site should be treated as an offer but merely as an invitation to do business with us.

9.4 If any provision of these terms of use is not fully enforceable for any reason, the remainder shall nonetheless continue to apply.
